1. Agreement and operator
These Terms of Use (“Terms”) are an agreement between you and the developer that publishes WakeFirst on the Apple App Store (“WakeFirst,” “we,” “us,” or the “Developer”). The seller/developer name shown on the WakeFirst App Store product page identifies the publishing operator. Contact: matt1232026@gmail.com.
These Terms cover the WakeFirst iOS app, its related features, and any legal pages we provide (together, the “Service”). By tapping “Agree & Continue,” downloading, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how information is handled and is part of the information governing your use of the Service.
Apple’s Licensed Application End User License Agreement and the App Store terms also apply to your use of the app. If a term here conflicts with a mandatory App Store term, the App Store term controls for the relevant app-store transaction. Nothing in these Terms limits a right that cannot lawfully be limited.
2. Eligibility
You must be legally able to accept these Terms where you live. WakeFirst is not directed to children under 13, and children under 13 may not use it. If you are under the age of majority where you live, a parent or legal guardian must review these Terms and supervise your use; paid features must be purchased or approved by an adult account holder. Where local law sets a higher age for a child’s independent consent to an online service, that higher age applies.
You are responsible for the accuracy of information you choose to enter into the app and for keeping access to your device secure. WakeFirst does not require you to create an account.
3. WakeFirst features
WakeFirst helps you plan a morning routine. Depending on your device, permissions, selected plan, and subscription, the app can schedule alarms, create a morning mission, compare a locally stored reference image, count steps on your device, apply app restrictions through Apple Family Controls, and show a local record of completed mornings.
Features depend on Apple operating system services, your device model and settings, network availability for store functions, and permissions you grant. Features may not be available in every country or on every device. WakeFirst does not operate a user account, social network, cloud history service, or emergency-response service.
4. Your licence
Subject to these Terms and Apple’s App Store rules, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use WakeFirst on Apple devices that you own or control for your personal, non-commercial use. You may not copy, modify, distribute, sell, rent, reverse engineer, or create derivative works of the Service except where applicable law gives you a non-waivable right to do so.
You may not misuse the Service, interfere with its operation, attempt to bypass app restrictions, or use it in a way that violates law or another person’s rights.
5. Your responsibilities
You choose your wake time, plan, selected apps, mission, and reference object. Check that those settings fit your needs, and keep your device charged, audible, accessible, and configured correctly. You are responsible for maintaining another reliable way to wake up when missing an alarm could create a risk or serious consequence.
Do not use WakeFirst to monitor another person without their knowledge, or to restrict a device you do not own or have authority to manage. Do not upload, store, or use images or other content in violation of another person’s privacy or intellectual-property rights.
6. Device permissions
Some features need access to Apple system capabilities. Camera or photo access is used only when you choose a reference image for an on-device scan. Motion access is used to count steps for a Walk Mission. Family Controls authorization lets Apple’s system apply restrictions to apps you select. Alarm-related system access lets WakeFirst schedule supported alarms.
You can refuse or revoke permissions in iOS Settings. A feature that needs a permission may stop working if you decline or revoke it. Apple controls those operating-system permissions and frameworks.
7. Safety, alarms, and health
Alarms and app restrictions can be affected by device power, operating-system behavior, permissions, Focus settings, hardware, or other conditions outside our control. A mission result is a productivity feature, not a measure of your health or fitness. WakeFirst is not a medical device and does not provide medical, sleep, or fitness advice. Talk with a qualified professional about health concerns.
9. Apple and other services
WakeFirst relies on Apple’s App Store, StoreKit, Family Controls, AlarmKit, Camera, Photos, Vision, and Core Motion services where you use the related features. Their terms and privacy practices apply to their own services. The app also uses RevenueCat to retrieve available subscription products and verify purchase entitlements. RevenueCat processes purchase-related information on our behalf; see its Privacy Policy.
Links to third-party sites are provided for convenience. We do not control those sites and their terms and privacy notices apply when you visit them.
10. Ownership and feedback
WakeFirst and its software, design, text, branding, and related materials are owned by the Developer or its licensors and are protected by intellectual-property laws. These Terms give you only the limited licence stated above.
You keep any rights you have in content you choose to use in WakeFirst. You grant no ownership rights to us by using the app. If you voluntarily send ideas or suggestions, you allow us to use them without restriction or payment, unless applicable law says otherwise.
11. Privacy
The Privacy Policy describes the app’s local processing, purchase verification, service providers, retention, and privacy choices. The policy is incorporated into these Terms for notice purposes. We do not sell personal information or use it for cross-context behavioral advertising.
12. Availability, updates, and changes to the app
We may update, improve, suspend, or discontinue all or part of the Service for operational, safety, security, legal, or product reasons. We will provide updates when required by law. Some changes may require you to install a newer version or update your device. We do not promise uninterrupted or error-free availability.
If a paid feature materially changes or ends, mandatory consumer-law remedies apply. Where reasonably possible, we will provide advance notice through the app, the App Store listing, or another appropriate channel.
13. Warranties and consumer rights
WakeFirst is provided subject to the consumer guarantees, conformity requirements, and other statutory protections that apply where you live. Nothing in these Terms excludes or limits a warranty or remedy that applicable law does not permit us to exclude or limit, including rights under applicable EU/EEA or UK digital-content and consumer-protection laws.
To the maximum extent permitted by law, and subject to the paragraph above, the Service is provided “as available.” We do not warrant that every alarm, mission, app restriction, or system integration will be available at all times, or that the app will meet a purpose you did not tell us about and we did not accept.
14. Liability
Nothing in these Terms limits liability for fraud, intentional misconduct, gross negligence where liability cannot be limited, death or personal injury caused by negligence where it cannot be limited, or any other liability that cannot lawfully be excluded.
To the extent permitted by law, the Developer is not liable for indirect or consequential loss, loss of profits, loss of data that was stored only on your device, or harm caused by device or operating-system settings outside our control. To the extent liability may be limited, our total liability for claims relating to the Service is limited to the amount you paid to the Developer for WakeFirst during the 12 months before the event giving rise to the claim. This limit does not reduce any non-waivable consumer remedy.
15. Suspension and termination
You may stop using WakeFirst at any time by deleting the app. Deleting the app does not cancel an App Store subscription. We may suspend or end your access if you materially violate these Terms, create a security or legal risk, or if we discontinue the Service. Where practical and lawful, we will give notice and an opportunity to address the issue.
Terms that by their nature should continue after use ends—including ownership, disclaimers, liability limits, and dispute provisions—will continue to apply. Statutory consumer rights remain unaffected.
16. Governing law and disputes
These Terms do not take away any mandatory consumer-protection rights or the right to bring a claim before a court that has jurisdiction under the law where you live. If a provision here is unenforceable, it will be limited to the minimum extent necessary and the remaining Terms will continue to apply. There is no mandatory arbitration or class-action waiver in these Terms.
17. Changes to these Terms
We may revise these Terms to reflect changes to WakeFirst, our legal obligations, or our operating practices. We will update the effective date above and provide prominent notice of material changes. If a change requires your renewed agreement by law, we will ask before it takes effect for your continued use. Continued use after a notified change takes effect means you accept the revised Terms, except where law requires another form of acceptance.
